Court-appointed child visitation, also known as supervised visitation, is a court-ordered arrangement that allows a child to visit a non-custodial parent under the supervision of a court-appointed person. The court may order supervised visitation if it believes the non-custodial parent is a danger to the child. Common reasons for this include:
The court will determine the frequency and duration of supervised visitation based on factors such as the potential risk, recommendations from court-appointed professionals, and testimony from the parties. The supervising party can be a court-appointed person, an approved family member, or a trained child development expert or social worker. The supervisor acts as a chaperone to ensure the non-custodial parent doesn't engage in behavior that could endanger the child. In some cases, the court may designate a specific visitation center where the visit will be supervised by the court and security professionals.
Supervised visitation is usually a temporary solution. If the parent can show the court that they have made progress and the restrictions are no longer necessary, the conditions will be gradually lessened.
On April 15, 2024, PA Gov. Josh Shapiro signed Senate Bill 55, widely known as Kayden’s Law, thus implementing sweeping changes to the Pennsylvania child custody statute by amending the child custody factors set forth in Title 23 to provide for greater emphasis on threats to children’s safety and well-being.
Kayden’s Law, which went into effect on Aug. 15, 2024, is named after 7-year-old Kayden Mancuso, a Bucks County child who was killed by her biological father in 2018.
The passage of Kayden’s Law marks a significant shift in Pennsylvania’s approach to custody disputes, placing greater emphasis on child safety and protection by mitigating the risk of harm to children caught in the crossfire of contentious custody battles when safety is at issue.
